1. Parties and Acceptance

These Terms of Service ("Terms") govern your access to and use of https://www.TrimbleProductionsOnline.com, the online store, and related services operated by Christopher Trimble ("we", "us", or "our"). By purchasing a digital image file or otherwise using the site (the “Site”), you agree to these Terms.

2. Definitions

“Digital Product” or “Image” means a downloadable image file offered for sale on the Site. “License” means the applicable end‑user license that governs how you may use an Image after purchase. “You” or “User” means the purchaser or visitor accessing the Site.

3. Eligibility

You must be at least 18 years old to make purchases. If you are under 18, you may only use the Site under the supervision of a parent or legal guardian who agrees to these Terms.

4. Accounts

You may be able to create an account to manage orders. You are responsible for maintaining the confidentiality of your login information and for all activity under your account.

5. Ordering, Delivery, and File Access

Digital Products are delivered by providing a unique download link after checkout to the email address you provide. Links may expire after a set period; if a link expires before you download your files, contact us for a refreshed link. We may provide files as compressed archives (e.g., .zip). Please review the product description for file type, color profile, and resolution details.

6. Color and Output Variance

Colors vary by screen/printer; we’re not responsible for differences versus on-screen previews. Files are delivered in sRGB unless noted.

7. Preview and Watermark Policy

Watermarks appear on previews only; delivered files are unwatermarked but contain copyright/usage metadata.

8. Download Window and Re‑delivery

We support re‑download requests for **30 days** from the purchase date. If your link expires or a download fails within this window, contact us at trimbleproductionsonline@gmail.com with your order number and we will provide a refreshed link at no additional charge. We may retire or remove products from the Site over time; prior purchases will be honored during the 30‑day re‑download window. After that period, re‑delivery is at our discretion and may not be available if the file is no longer archived.

9. Pricing, Payments, and Taxes

Prices are listed in U.S. dollars and may change without notice. We accept payment methods shown at checkout. You are responsible for any applicable sales, use, value‑added, or similar taxes, duties, or levies. Where required, we will collect tax at checkout.

10. Licenses for Purchased Images

All purchases of Images are subject to the separate Personal Use Image License (the “License”). The License sets the permitted scope of use after purchase. If there is a conflict between these Terms and the License regarding use of the Image, the License controls.

11. Refunds, Cancellations, and Chargebacks

All sales of Digital Products are final once a download has occurred. If you experience a failed or corrupted download within 7 days of purchase, contact us for assistance. Because files are delivered electronically, we do not accept cancellations after a download link has been issued. Unauthorized chargebacks are a breach of these Terms; we reserve all rights to contest chargebacks and seek repayment. 12. Intellectual Property and Site Content

All Images and other content on the Site are protected by copyright and other intellectual property laws and are owned by or licensed to us. Except as expressly permitted by an applicable License, you may not copy, modify, distribute, publicly display, or create derivative works from the content on the Site.

13. Acceptable Use

You agree not to misuse the Site or attempt to interfere with its normal operation. Prohibited conduct includes unauthorized access, scraping, automated bulk downloading, introducing malware, or attempting to bypass technical measures protecting the Images or the Site.

14. Third‑Party Services and Links

We may use third‑party service providers (e.g., website hosting, payment processors, email services, analytics). Your use of those services may be subject to the providers’ own terms and privacy policies. We are not responsible for third‑party sites or services.

15. DMCA Policy

We respect intellectual property rights. If you believe content on the Site infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act (DMCA). Include: (a) your signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material; (d) your contact information; (e) a statement of good‑faith belief; and (f) a statement that the information is accurate and, under penalty of perjury, you are authorized to act. Send notices to trimbleproductionsonline@gmail.com. We may remove or disable access to the material and, when appropriate, terminate repeat infringers.

17. Warranty Disclaimer

THE SITE AND ALL DIGITAL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. We do not warrant that files will be error‑free, compatible with your software, or that the Site will be uninterrupted.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF DIGITAL PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE DIGITAL PRODUCT GIVING RISE TO THE CLAIM.

19. Indemnification

You agree to defend, indemnify, and hold harmless Christopher Trimble, and our affiliates, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your misuse of the Site or breach of these Terms.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to its conflict‑of‑laws principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona.

21. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new Effective Date. Your continued use of the Site after the Effective Date constitutes acceptance of the updated Terms.
